Transfer of property after death of head of the family

Sir My father has immovable property (house)in Gujarat. But we are living in Delhi form two decades. My father is expired In my family there are my mother, three sisters and I(son) I want to transfer my father's Gujarat property in the name of me and my mother. What would be the procedure for that? And which type of certified will be required surviving members certificate or legal heir certificate? And my three sisters have no objection in the transfer of property in the name of me and my mother. At what time NOC will be required from three sisters What should I do first ? Please explain the procedure for transfer.

Query perused. I would advise you to apply for legal heir certificate initially by applying with the concerned revenue department. You would require Noc from other legal heirs at the time of applying for mutation. For further consultancy and legal services you may contact us.

There is an extensive procedure to get the title of the property transferred in your mother's name. A detailed perusal of all necessary documents is pertinent. Further and better particulars are needed for an effective opinion.

Hello, sir, I have perused your query. sir, you can apply for the grant of a succession certificate in a competent civil court of law. To obtain succession certificate, a petition to the District Judge within whose jurisdiction the deceased person ordinarily resided at the time of his or her death or, if at that time he or she had no fixed place of residence, the District Judge within whose jurisdiction any part of the property of the deceased may be found.
