17-Nov-2024 (In Property Law)
We live in the house bought by my grandparents. My grandparents are no more. All their legal heirs had relinquished their share in favour of my father. My father has passed away. RD is available. Is it possible to transfer the ownership? Please share the legal way.

Yes, if you are the only legal heir of that property, and no other person is claiming rights over that property then you can file a succession petition and get ownership of the property through the court.

Yes, it is very much possible. You need to hire an advocate who will file a civil declaration suit in court by making relevant persons and departments as parties to the suit. It will ultimately come down to the expertise of an advocate who can make the process easy and fast.

Yes you could get the property transferred in your name and in your siblings and mother by filing declaration suit in the appropriate civil court with appropriate court fee. Just consult an advocate for the same.

we will have to see what happened after the death of your father whether he left any WILL or his legal heirs also executed a RD. If there is a WILL, the course of action is different and if there is RD course of action is different.
