Transfer Joint property to single

Hi, I own a flat in Delhi which is registered in my and my wife's name. I am the 1st applicant and my wife is the 2nd applicant. My is no more.I want to transfer my wife share of property to me. How can I do this ? any modality. Further will it involve stamp duty fee. Please advise

in order to provide adequate advice, facts given by you do not finds mention surviving legal heirs of your wife as it is necessary and important to mention the said fact in preparation of required document. with surviving legal heirs information, it would be decided as to which documents suits to your need. question of stamp duty shall also answered accordingly.

it's being presumed that the flat was purchased by your money or your wife's own money and not from her parents' money because in that case, the answer shall be different. if it was a self acquired property, then in absence of any will, the property of your wife will come to you and your children. if you don't have any children, you will get it.

If your wife dies intestate without a will, then her share will belong to him accordingly Hindu Succession Act. If no will, you may submit an application along with the all documents to the Tehsildar concerned for transfer the share of her property.
