Transfer flats into mother's name after father demise

29-Aug-2023 (In Property Law)
Hello sir, my father recently died due to covid 19. While thinking if changing flat ownership in mother's name we cudnt find original share certificate & possesion letter issued by cooperative group housing society may be it is misplaced or lost. We are 4 siblings. One sister living outside delhi. Even there is no nomination in this flat. Pls guide me from issuance of (1) duplicate share certificate & possession letter (2) mutation of name in mother's name to conversion from (3) leasehold to freehold. What all documents require n procedure to be followed, whom to contact and how much time will compete procedure take?

Hi, For lost share certificate and possession letter you should file online complaint. You can transfer the property in the name of your mother by way of relinquishment deed. After getting the relinquishment deed you can approach the society office bearers and they will change their record and you can apply for getting the flat freehold . Thanks Ramit Sehrawat Advocate
