20-May-2025 (In Property Law)
A Hindu male died intestate in 2017, leaving his widow, mother (died 2021), brother, and two sisters. The widow filed for LoA in Bombay High Court. As the mother died later, her heirs (brother and sisters) would consent. Consent affidavits may imply rights, so a registered Release Deed is advised. With properties in Raigad, Navi Mumbai, and Mumbai slum area, is one deed covering all valid for court and future sale, or are separate deeds needed per jurisdiction? If not Registered Deed what doc?
Dear Client,
Whether Letters of Administration are obtained from the competent court?
For the purpose of future sales of the mentioned properties separate Sale Deed/Transfer Deeds need to be executed within the jurisdiction whether the respective properties are situated.
Need the following details to proceed further
When dealing with a release deed for distinct immovable properties at distinct locations in one state, it needs to be drafted and registered separately for each property in its concerned Office of Registrar of Assurances. The registration process ensures the document's legal validity and acts as evidence in case of disputes.
