The seller is not willing to pay back the money paid against sale deed

I have to purchase an old house.For that,I exchange my plot.The plot value is less than the old house.There I have given an advance of Rs.2.5 lakhs with unregistered sale deed.Now the other party is hesitating to give his house or he is not returning my Rs.2.5 lakhs .What shall I do?

In this case, you can move in 2 ways. One is Civil court action for return of money and the other way is to move a criminal case for cheating and misappropriation of money. Even though you can opt either or both options, I would advice you to take the second option initially, as it is fast and comparatively cheaper.
