The builder has not made house with Quality Material

I bought a builder floor in Delhi and the registry is done. There was some work left and builder promised that it would be done post we shift to the house. However, it has now been 8 months and he has not done any work. Also, the quality of the house is so bad that we are seeing cracks on walls, damp walls. He has not installed the elevator as well. On top of that he is running a hostel in the remaining vacant flats. He never asked us for this. He has also opened a shop in the parking and there is a large kitchen which he has opened in the parking for hostel kids. Its a freehold property. I just wanted to know what my legal options are. These builders do not come under RERA so, I want to know what actions I can take against him.
Do I have an option for consumer court for the compensation?
If the builder has used inferior quality material you can sue him , you have Various remedies you can sue him in Rida as well as in consumer Court earlier there was restriction that if you initiate action against builder in Rera you cannot use the same builder in consumer Court but now there is a judgement of honourable Delhi High Court which says that you can sue him Rida as well as in consumer Court
a builder is a service provider and you are a consumer as per the consumer protection law. even if the builder came under rera, you would still have the option to approach the consumer forum. in your case you can surely file a complaint before the consumer forum seeking compensation for the illegalities committed by the builder.
