Terrace right for top floor or not.............................

I purchased a flat in 2017,. And having docs mentioned terrace exclusively for 2nd and third floor. In our society some block buding have 2 floor and some 3. Its also mentioned ground floor have lawn and first floor have open terrace adjoining there flats. Now question is , terrace above 2nd or 3rd floor flat is exclusivly for them or not. As sometimes ground and 1st floor fight for this reason.

These days terrace rights are also sold by the owners just to fetch out money. But usually the terrace belongs to the top floor of the building. Ground floor can’t claim any right over the terrace. For more legal assistance I am just a call away.

If the document mentions then it’s for exclusive use of the owners concerned although other floors have easement right of cable TV dish and water tank installation etc as per law which must be mentioned in document

yes it is exclusively for them if the mou states that, as the agreement you got at time of purchasing the flat.
please read through it.
now there will be 2 options
1. if it states only for 2 and 3rd floor then other floors members visiting would be liable under trespass
2 if it doesn't state anything then all the members can enjoy the terrace.

at end I would like to suggest is read Mou properly for any other legal assistance contact an advocate
