Tenant not vacating house after lease period staying more than 8 month

Tenant is not vacating the house after lease period-staying more than 8 months without rent.Reported to police and appointed advocate from lawrato but he not attended the court for the first hearing and asking 3 months to appoint a counter.My advocate what have to do for eviction of the tenant?

Hi sir madam. your tenant not vacating mean you can file wilful default and eviction case and also file arrear of rent also so you don't go for police because this is civil case

You have not mentioned where the property is situated and hence giving a general advice . Read your agreement and the tenant committed lapses first move the Rent controller and wait for his orders and then move the civil court.

The police may not evince interest in your case, as it is only civil in nature, and not criminal. If your lawyer has filed a suit already and if his services are not satisfactory, you may think of engaging another lawyer to proceed further.
