Tenant is not vacating the house

12-Mar-2023 (In Property Law)
Hi , Our tenant is not vacating the house while notice period has already been given for 30 days and it's already more than 60 days. I have filed the FIR to the nearest police station as well but police is neither taking any kind of action nor helping. What will be the way out here. What do you suggest to file a case in court or there will some other ways as well . Kindly advice.

You can file a civil suit for mandatory injunction to get your property vacated. The court once orders that your tenants stay in the property is wrong even after you serving a notice, it will order him to vacate. It seems that the present case is of civil nature and police might not take any steps. Rest can be answered after having a look at your documents.

Query perused. I would advise you to file a suit for eviction against the tenant at the earliest possible. Police will not be able to help. Legal proceedings has to be initiated. For further consultancy and legal services you may contact us.
