Suing competitor who has petrol pump within 300 metre of brick factory

Hi, my competitor has a petrol pump and within 300 meters there are brick factories which are highly inflammable. If that is illegal i want to raise a case against him. Also i need lawyer for the same if this is illegal.

you first need to collect information for this. file a RTI and get the relevant information-does he have a license, permits, safety permits, etc. once you get this information you can take it forward.

As such you both have right to livlihood in India, and you can have means. So no law can prohobit him to do business. However if you can prove that he came much later in this business at that place to affact your business, and this is against regulations for having petrolpump in your place. And petrolpump is a bitter requirement of that area, and brick production may be done somewhere else and many other points to establish that your rights are better than his and you need protection and compensation also. Then you can file an injunction suit in Court of law.

Definitely if it is within radius of inflamable factories then his license and NOC granted by the state or district can be stand cancelled or suspended,Therfore how he obtained a license and NOC is also a question.As the area as per Petrolium Act 1934 under Ministry of P

You may file a complaint before SDM and he may take cognizance for the same U/s 133 CrPC.
You may also file a case before concerned civil judge for stopping the work and having the stay. But in this case, you have to show that how are you affected.
You may also file a complaint before the government (i.e. Ministry of petroleum) and intimate them in this regard, and for the consequent irreparable losses.
It is not to be forgotten that you are competitor, and this fact will give prima facie effect of personal grudge rather than for public safety.
