Succession certificate for legal heirs when person dies without a wil

I have a question on succession certificate in the event a person dies without a will. Can succession certificate be issued to multiple legal heirs or is it issued to only one legal heir? Can their be multiple legal heir as petitioners on the succession certificate?

Yes there can be multiple petitioners in the Succession Petition for the movable properties of the deceased. In case there are immoveable properties you need to file a petition for grant of Letter of Administration

Succession certificate can be issued to all the concerned legal heirs and not just one. The fact that they’re legal heirs of the deceased person itself makes them eligible for the certificate provided that are in need of it. As far as your second question is concerned, yes there can be multiple legal heirs on the succession certificate.

Succession certificate is for particular movable property or properties. when the application is filed all the legal heirs are always party to it or they all the give NOC. Or if they don’t appear ex parte decree is granted or if anyone objects then trail begins ..b in touch with us to understand the legalities..thanks a lot
