Sub Registrar registered property against PDC
24-Feb-2025 (In Property Law)
I have registered a Ancestors property to a stranger with PDC. Though I had registered now these cheques are now bounced and stranger is cheating me and spreading false word of mouth saying 70 L has beennpaid against property. I am in a dilemma whom to approach yo sort out my problem. I need to know can a Head clerk register a property in PDC. Can I lodge a FIR from my Hometown Andhra Pradesh. Please guide me.
Given your situation, where you have registered an ancestral property to a stranger with post-dated cheques that have bounced, and the stranger is spreading false information, here are the legal actions you can consider:
1.Issue a Cheque Bounce Notice
2.File a Criminal Complaint
3.Civil Suit for Recovery
4.Fir for Fraud
5.Cancellation of Sale Deed
6.Declaratory Suit
Since the buyer failed to make the agreed payment, the sale lacks valid consideration, making it voidable under Section 31 of the Specific Relief Act, 1963.
You can file a civil suit for cancellation of the sale deed before the competent court.
You may also seek a permanent injunction to prevent the buyer from selling or transferring the property. You can lodge an FIR against the buyer for fraud at your hometown police station, but the local police may redirect it to the jurisdiction where the sale occurred.
