Stamp duty on immovable property from Relative

My Chacha (Father's brother) wants to gift an immovable property to be in Mumbai. What will be the stamp duty rate on this? Will it be at 3% (gift from relative) or at the normal rate?

Stamp duty on a gift deed executed between blood relatives is nominal plus metropolitan cess as compared to the normal charges. Feel free to contact me for seeking any legal advice/assistance as regards the same.

If your own Uncle wants to gift you an Immoveable Property, then, you end up paying Stamp Duty of Rs 200, as your Uncle falls amongst the closed blood relations, and, as per the law of Maharashtra, if the Property is getting transferred via execution of the Gift Deed before the concerned Registrar, then, the Stamp Duty which that transferee has to shell is Rs 200 along with Standard Registration fees.

Exemption on Stamp duty is only given to the blood relatives which include father and mother. Also the exemption is given to husband and wife relationship. Since your uncle is transferring the property in your name the same is not exempted under the stamps Act, hence entire duty would be applicable as per the date of conveyance.
