Stamp duty and registration charges on family settlement deed in WB

20-Apr-2023 (In Property Law)
There is a property were my grand father and his sons are also the co-owner of the property. Every one is enjoying their respective portion or flats as per their investments of share in the property Via a registered Partition Deed Now post my grand fathers death he distributed his share of portion or flat of the property to his sons as he wished by virtue of registered will he left behind. Now we mutually want to file a family settlement deed for better partition or distribution among ourselves with little change for our better use and register the same to avoid any problems in future. so i want to know what will be the stamp duty and registration charges applicable for the settlement deed in Kolkata, West Bengal? Whereas its amongst the family members. Please tell the total percentage of charges applicable on it in Kolkata city of west bengal

The total charge will depend upon IGR value. Stamp duty will be 0.5 % of the total IGR value and registration charges may vary but cannot exceed 1 % of IGR. The whole drafting, notary, printing on stamp paper and the other print out in A3 which will be submitted by you. And the whole registry charges charged by registry office will be 8k in which they will take there extra money as you know how it is. our legal fees will be 1% of the total IGR value. We are a Law firm situated opposite High Court Calcutta. So 0.5%+1%+8k+registration fee which cannot be more than 1% .So call us

If you want to execute the family settlement deed them let me tell you, that it is not compulsorily be registration, but by don't of that family settlement deed will or other legal heirs will not able to transfer the said property got by then by such family settlement deed. The next option is there partition deed which is compulsorily be registration and for Knowing the stamp duty and registration fee you have to get your query first where the government valuation of the said property along with stamp duty and registration fee will appear. And you can generate the said query online at 'wbregistration.gov.in' website
