Sold property to a person, he was not paying so I cancelled the deal

I had a property 30x40 in north bangalore have saled a property in 2007 value of Rs5,80000. where I was given 11 months time period to oppsite party where only sale deed was made.with out any registration& he has made a payment of Rs. 200000/- The opposition party was titled to pay us with in time period of 11 months. As he was not paying properly with in time period, before that i have cancelled the deal by sending resgisterd notice to opposite party. Where opposite party has filed case against me in 2007, now as he has also woned in civil court 2012 on his favour For taking balance amount & register him with property . now I have applied to high court in 2012 from 2012 my case is not coming up,as it's long time (RFA). I need suggestion what can be done ? As I m unhappy even with my lawyer on this . Looking for suggestion please help .

In this case you need not to worry as the opposite party has not paid the due amount. You can hire a good lawyer and make your case as to which should favor you. You can also contact the relevant authorities if any of your right has been infringed.

Time is the essence of contract and as per your statement as opposite party has failed to comply within the time limit of the agreement you have terminated the agreement and there is no wrong in it. Further we have to go through the documents and file to know the crux of the matter. About your matter at High Court the memo has to be moved by your advocate at the concerned court hall and has to do the follow at pending branch and board branch to make it to post before the court. Now a days to post the matter before High Court has also become very complicated as continuous follow up is required which the clerk or advocates can only do.

Here as you told you request your advocate to post the matter immediately. You counsel may know that there is may be some inconvenience he know the real aspect of the proceeding.

Please request him. In case if there is that much urgency you can file a an application for early hearing. Here you need to explain the reason for the urgency.
