Sir I have one shop on ground floor and rest of the building has one another owner he is going to make flats above my shop without my permission plz help me how can I stop him I have complained police report but nothing happened I have file complained in MCD DELHI BUT STILL CONSTRUCTION IS GOING ON 7 DAYS HAS BEEN PASSED AND MY SHOP IS DAMAGED WHEN I TALK TO HIM HE IS BEGAN TO FIGHT WHAT SHOULD I DO PLZ HELP
You should file a suit for permanent and mandatory injunction thereby restraining the defendants from doing construction. Do it asap and seek stay from the Hon'ble Court . For further consultancy and legal services you may contact us .

the property on top of your shop does not belong to you so the other person can do whatever he pleases with his property. that being said, he has no right and should take proper care that it should not damage our property. it will be difficult to proceed under the IPC but there are several remedies available under civil law
