Sibling demand for more share of my father's property

24-Sep-2024 (In Property Law)
My father had bought an agricultural land which was solely earned by my father money, he passed away 5years ago and now we are planning to share the property amongst 5 siblings equally, however one of the sibling my brother is demanding for bigger share of the property, we have the RTC transferred to the joint including my mother and daughter and brother. We are asking him to come sign the documents but he is refusing. Please advise what should be done in the situation like this.

If he is refusing to sign the documents, you can send a legal notice, prepare an 11E sketch excluding his applicable portion, and proceed with dividing the remaining property, or you can file a partition suit.

On which document you are asking him to sign ? Is it partition / arrangement document ? Though he is. asking for bigger share, he is only entitled to equal share like the rest of you, if he refuses, you can file for partition in Court.
