Shared ancestral property decades ago, can we file case equal share?

20-Jul-2023 (In Property Law)
Our father has 3 brothers and Our ancestral property is divided in 1991. Property is transferred to my father and uncle's name. Out of 28 acres, my father got 5 acres as he had self acquired property of 8 acres in another place. If I file case now for equal share, will I get the equal share as 28 acres is not equally divided. My father transferred the rights of land to my name and I have sold 2 acres for my financial needs. will it impact my case?

As per the facts, the ancestral property was partitioned in 1991 between your father and uncle. So since it is already partitioned you cannot move for repartition of property. At the time of partition, till now there is no objections as made.
