Share in the father's property on father being alive

Sir, we are two brothers. My father is alive. He has some acre of land and is selling without my consent. Eventhough he is not giving me a penny. I am a government employee. I just want to stop him selling properties legally or i want my share in my father's properties.what I can do for that?

Dear Client,

If the property is self purchased by your father than he is absolute owner of the property and he can sale, gift, mortgage etc for the property. But if the property is an ancestral property, you can claim for your own share. The right to ancestral property acquire at birth unlike other laws of inheritance where right arises upon the death of the the owner.

Perhaps u had asked this query earlier also. If the property is HUF property and ur father is karta of HUF then he can sell the property but proceeds of the property must be used for the purpose of HUF. If ur father is using the proceed for his individual purpose u can ask ur share.
