My grandfather gifted self constructed Two storey house to his two sons. Ground floor to my father via gift deed in 2001along with proportionate share in land beneath and First floor along with terrace to my uncle along with proportionate share in land beneath in 2004. My uncle sold his portion via sale deed in 2022 mentioning he is selling his 2/3 right in property. Do we need to file court case challenging his sale deed and % share in property and how
After obtaining the copy of sale deed of your uncle, file a suit for declaration that sale deed is invalid to the extent it extends his legitimate ownership share and permanent injunction in the civil court where property is situated so that your uncle cannot transfer more share than he has got . also time is crucial so please file the case quickly.
