Seeking advice on fees for obtaining an old Death Certificate

06-Oct-2026 (In Property Law)
Iam a senior citizen. I need to obtain death certificates of my parents, who died many decades ago in Hyderabad, but the original death records/certificates are not available. We consulted an advocate who advised that we should first apply for a Non-Availability Certificate (NAC) and subsequently proceed with obtaining the Death Certificate. The advocate is asking ₹10,000 upfront towards NAC-related office expenses and there is further expense to revenue department . Should I pay him upfront?

There is a remedy. For decades-old deaths, obtain a Non-Availability Certificate from the concerned Registrar of Births & Deaths and then seek delayed registration under Section 13(3). Do not pay ₹10,000 as “office expenses” without a clear breakup and official receipts.

Whether to make the payment is ultimately your decision after discussing the scope of work and fee arrangement with the advocate you have engaged. Since the matter involves obtaining old death records and may require multiple procedural steps, it would be appropriate to ask the advocate for a clear break-up of professional fees, official/government charges and anticipated out-of-pocket expenses, and the specific work covered by the ₹10,000 advance. You may then make an informed decision based on the explanation and agreed terms.
