Section 29 of the Maharashtra Society Act

I have purchased a property which was transferred in the name of legal heir 3 months back as father expired. Due to financial needs he is selling the flat , so Section 29 of the maharashtra society act will be applicable or not in this case where the legal heir has to withhold the shares for an year under his name. As the property was transferred due to legal heir is this still required and this is transmission of property rights due to deceased scenario and not a transfer of property via sale deed
