Sale agreement dispute after get advance mony land lord dined to

I have made sale agreement for property purchase i am second party. I had given advanced 10 % amount. Verbally discuss pay ment mode cheq/rtgs or dd. But now land loard said to me i need all payment in cash. Payment mode not maintain in sale agreement. I am aware that cash not safe because total amount remained rs 860000.00. Can we file fir for recover advance (byana) amount.

This 10% you paid was in cash or through transfer?

Have you signed the sale agreement?

Sale Deed won't be valid if the amount is paid in cash as you have mentioned correctly.

To recover the said amount you may file a complaint under fraud to the PS.

You may contact with agreement to sell. The agreement needs to be perused to tender a considered opinion on the same. The earnest money or bayana can be recovered. Cash payment of the balance amount is not advisable

It depends what is written in the contract ! You must see what are the condition clause in the agreement ! Furthermore, you must issue him the legal notice for the cash payment he is asking now bcoz as per income tax there is certain limit to cash transaction until shown
