Rights over the property in case different name mentioned in records
24-Nov-2023 (In Property Law)
I have land 2 acres it's came from my grandfather's. 1954 to till now we are cultivating that land. In revenue records pahani 1954 to till now my grandfather name is there. But 1974year 38-E issued some other person. Now my doubt is who as more rights on land ..
The other persons will have right. Because from 1974 when the other persons name appeared, you have not taken any steps nor challenged the other person's right. Hence, even assuming that he is not legal title holder, he got title by adverse possession. It is too late to fight against him. Anyway you chances to win the battle, if you pursue the case carefully. Contact me through Lawrato.

If the land belongs to your Grand Father then all the legal heirs of your grand Father have equal rights over the said land, that the said other person is not legal heir of grand father then you can file the case against the such person to delete name from the pahani.
