Rights of my husband over his mother's property after her death
05-Jan-2023 (In Property Law)
Hello My Brother-in-law has been nominated in all movable and immovable assets based in Pune & Mumbai. All the assets are in the name of my Mother in law. In case of any unfortunate event, will all this be transferred to him directly? Or will my Husband have a say.
Nomination is not a transfer of property in the name of Nominee in the event of death of the owner of a property. The property/ies which are in the name of your mother-in-law will devolve upon her legal heirs in the event of her death if she dies without making a WILL and if she makes a WILL then on her death the properties will devolve as per the WILL for which you need to obtain Probate from the Court after her death.
nomination doesn't amount to transfer of property on unfortunate event the nominee acts as trustee of the property . he is entitled to get entire ownership without consent of other heirs. nominee is kept just to maintain property if person dies the tax collecting authority or the dues collecting authority whom they will catch for dues for that reason nominee is appointed and in no other sense nominee can bequeath the property without consent or parting share of the legal heir
hi Dear client.....if anyone is nominee then that particular person has full right over assets for which he or she is a nominee.so in this above caste u cant do anything because your brother in law is nominee here.
