Q: Which of the Will's will be considered if there are two different Will
My father made a will in 2010 in favour of my two sisters. He died in 2016. Father's will is not probated till now. My mother made a will in 2022 in favour of us (three children) with equal percentage and my mother died after making the will. We want the property to be in the name of all three of us. Which of the will is more important and effective? Father and mother both were owners of the flat with 50% each ownership. But the flat is on my mother's name. What to do now? We are Hindu. We are from Mumbai.

get a probate of both will in one testamentary application from Bombay High court original side. as u said it parents both were owners that means both have equal share so better get probate of both will
Q: certificate under indian evidance act
We issue computerized invoice and ledger to our customers . customers dishonored the payment cheque we filed case under section 138. Honorable court ask us to produce certificate under Indian evidence act . we required suggestion which certificate we produce to Court and they also ask take certificate from Bank for Cheque Returned by Bank.

certificate under section 65B of Indian evidence Act needs to be filed along with all electronic documentary evidence.the said certificate has no format you can customise the certificate as per your requirement
Q: How to get speedy NOC from builder for sale of property
We want to sale our flat. But the society is not firmed yet. The buyer bank asking for NOC. The builder is taking time to give the NOC. There is any other way?

Q: Can daughters claim the property of mother
As Hindu family, they have a widowed mother, two daughters and son now the widowed mother is bedridden and the agriculture land is taken by the government the 50% amount has come in the account. Do the two married daughters have the right to claim on mothers amount?

Q: The most convenient way for transfer of property from mother to son
My mother and I own an open plot of land which is 3000 sq ft. can we use the Hakka sodha patra method to transfer her share to me since the mother is transferring to son will there be stamp duty? I am hindu by religion. I am really confused which is the best and economical way as out of 5 lawyers 3 have suggested gift deed and other two Hakka sodha patra or relinquishment deed. Please suggest the best method & what are the disadvantages of relinquishment deed compared to gift deed. Is stamp duty applicable in relinquishment deed in my case? please help. also it states no tax benefits incase of relinquishing I don’t understand what it means. does it mean when I sell I will have to pay income tax in relation to capital gains or cannot claim benefit in terms of the cost to make this deed. if no stamp duty then I would definitely go for Hakka sodha patra then why all lawyers are not on same page.
