Rights of children on father's property after his death

My father had expired in 2000. I am a Hindu.The property and assets were transferred automatically in my mother's name after my father's death. I have one elder sister.Do I and my sister have rights on house/ property.Can my mother transfer my father's hard earned property on any ones name in her will ?If the house property is to be divided amongst mother, me and sister, will the house have to be sold for division of property?

All of you family members have legal right over that property. Its important that weather that property is self acquired or ancestral of your father. The ratio will be differ in every case. It is also importance you belongs to which customs and law like Hindu/Muslim/Christian.

According to transfer of property act 1882 said that your mother and you and your elder sister is the legal heirs of your father so here either your mother live or expired the share of property and asset will be you and your elder sister so if you want to transfer your share separately then you can sale separately.
