Right of younger brother to claim share in proprty acquired by brother
12-Aug-2023 (In Property Law)
My brother purchased a Land in the name of his wife when I was ten years old and my father was a government servant. Is there any provision of laws to get the my share in that Land?I am Hindu Brahmin.
If you may be able to prove before the court that this land was purchased with the joint family, you along with your father and brother, fund then certainly you are entitled to get a share in the land.
As per law you can not claim share in the said property which is in the name of your brother's wife. However, you successfully proved that property whish is in the name of your brother's wife belongs to hindu undivided property then you can claim share in it.
