Right of daughter in the property of parents without a will

Myself belong to Hindu Religion, I need your suggestion. Here is the scenario: My father is no more and i am the only married daughter of my parents. I have a plot and a flat in Jaipur for plot which is in the name of my mom only, for flat where my mom is the 1st owner and myself is second owner. I wanted to know that in this case if my mom does not make any will (as i am the only married daughter) and some thing unfortunate happens to her in future then all the property will be transferred in my name automatically or do i need any paper work for this? Please guide, so that we can do the needful as required.

If you make a will for your name from your mother then it will be good.As you mentioned, if you are the only heir that property, so after your mother that property will get your name . If no one heir claim on that property.

Hi, As per documentation process you must have to notify the concerned department with the evidence like death certificate and application for Mutation. by this process you can transfer the property on your name. It would be good that your mother execute a registered will for you. Some times you are the "only heir" that would be declared by the civil court. Some of legal document which can present that you are the only heir is must required in some cases.

As per your query you are the only married daughter of your parents since because the property stands in the name of your mother and you are the only legal representative of of your parents therefore I don't think there is any harm in respect to your property the property will automatically transfer after your mother in your name
