Right in ancestral property of family members

My Grandparents have died long back in 1990. our Family have ancestral property of 10 acres. family consists of My father, Mother, Father's sister(Bua and she is married ), my sister(Married) and my wife. Sir my question is about the property rights of each member in the ancestral property.

You have the right in ancestral property. One half share will go to your bus and other half will come to your father side. You will get one forth share of that property. As per law your sister will also get share irrespective of her marriage. She can relinquish her right in your favour. But for all this you have to file a case for partition before the civil court. All the best.

Please note that your query lacks the requisite details to identify whether the property mentioned actually qualifies as an ancestral property in law or not so much so that the concept of ancestral property no longer exists. Your father his sisters and you and your sisters all have right in ancesteral property but your mother has right through your father and your wife has right through you. First property equally distributed among your fTher and his sister and the. Out of the share of hour father your mother you and your sister can claim

grandparents include both gf and gm ... both dead if so then the last one who died intestate i.e. without any will. their legal heirs will be his son, daughter... property of your grand father will be divided between your father and his sister in two equal halves..

thereafter from your father's share, you will get your share in equal ratio with that of your mother, sister, father. your wife will get her share from your shares.. as she is your legal heir..

eg. GF - 10 acres divided into your bua and father - 5 acres each

5 acres now divided into your father, mother, sister and you i.e. 5/4 = 1.25 acres each

now your wife will get share with you, if you dont have any children she will get half share ..
