Request for information on Married Daughter's Equal Right to Property

we are 4 sisters and 2 brothers. my father died in 1987 but my mother is still alive. we four sisters are married and are in the age group of 35-50 yrs. my father has left a lot of property, and my brothers want to sell them and share the money between them without consulting or including us. now my question is: do we 4 sisters have any claim in this property? if yes under which law, section etc. what should be the most peaceful legal channel to claim our right to our father's property in india? all we want is that the property be divided equally among 6 siblings ( sons and daughters). my mother is reluctant to give the property to us. she wants to give the entire property to our brothers. kindly advise what should we do!!!!

You can file suit for partition giving equal share to each legal heirs. Besides you czn seek injunction or stay orders agaist your brother who want to sell the property. You can also first issue legal notice . You may consult me through this site. I am in Delhi High court.

Yes there is a provision in law to divide the property of father in children equally (male and female) so u can claim your share. You are 6 brother and sister so there will be 7 share one of your mother's as well. To ask for your share you can file a case under civil procedure i.e. suit for partition. Where the property will be equally divided among 7 share holders. The court will either ask to sell the property and divide the amount equally or if your brothers want to keep the property then without selling they will pay you all sisters a considerable amount.
