Remedy if one of the joint holder of property refusing to use the land

My grandpa have given 3 guntha land to my mom but the 7/12 of that land is having multiple names. All the names on that 7/12 is ready to give NOC to build bunglow on that land but only one aunt is opposing for the same. She is not giving any response what should be done from 2013 till date. What is the solution how can the 7/12 can be seperated or how i can go furthur with this? As i have to build bunglow on the said land.

Hi. Send her a legal notice through ur advocate. Make application to that effect to tahsildar or concerned officer as per ur jurisdiction. Thereafter if its not resolved then make a request for partition or demarcation mutually with other owners. If the concerned authority is not taking cognizance for mutually demarcation then all owners need to file declaration suit.

File a partition suit and get all the members on your side and separate out the land keeping her part separate and then as per decree of the court you can construct Bungalow on the piece of land alloted to your group.

Ask her to file for a partition suit and get the land partitioned is. your aunts portion of land. In such case the land will be partitioned and her land will get separated on papers and 7/12 extract as well
