Registry of property from seller side

08-Sep-2023 (In Property Law)
I wanted to purchase a home owner of which has GPA on his deceased mother's name. After his mother's death there were 5 legal heirs who later execute RD on their elder brother's name. Is it legally ok to purchase a property stand on GPA? Or seller needs to made registry first then I should go to purchase it?

many a time similar questions are being asked by innocent citizen of our country weather property can be purchased by way of general power of attorney or through will or registered will as per Supreme Court judgement we can be transferred and no Transfer of Property can be absolute and safe under Transfer of Property Act hundred rupees of value other word any property it can only be transferred by registered sale deed before competent authority and that competent authority is the registrar before whom the registry of a document takes place under Registration Act now make it clear that any property which and through general power of attorney registered will treated as agreement to sale seller who is having property through general power of attorney is only if Tu agreement or contract where hi has promised with his earlier his seller would sell that property to him and that is known as agreement to sale and in your case the seller to have no clear title therefore things can be clear and authentic only after perusal of record request your seller to provide you xerox copy of his ownership document and used through those documents to a competent lawyer
