If your father purchased the plot in 1985 and you have valid title documents (sale deed/registry) but possession has still not been handed over, your remedy lies mainly before the Civil Court, not only the Tehsil or SDM Court. Revenue proceedings decide entries and possession for record purposes, but ownership and actual possession are finally decided by a Civil Court. You may file or continue a civil suit for declaration of title, recovery of possession and permanent injunction against the persons in illegal possession. If earlier cases were not properly conducted, the records can be reviewed to see whether appeal, revision or a fresh properly framed civil suit is required. Before engaging a new lawyer, collect all documents such as registry, maps, revenue records, court orders, and case papers. A detailed document review is essential to build a strong case. A competent property lawyer in Indore can effectively pursue your matter, but first the legal strategy must be corrected based on facts and past proceedings.
