Regarding nominee rights in fd who is also a legal heir
13-Aug-2023 (In Property Law)
My father passed away this year in April. He made some fds and made my brother a nominee in that.. I want to know can I claim my share in the fds
Yes, you can definitely claim your share in the said FDs. The role of the nominee is just as same as that-of a trustee. You and your brother both are class- 1 legal heirs to your father. Therefore, you both have equal right over the said FDs and all other properties, if any.
