Regarding issue between family

14-Feb-2023 (In Property Law)
We have a property in Rajouri Garden, Delhi in front of main market near Metro station. And the will of the property says that both the 2 brother and sister gets half when selling and for living in a portion of 40-40 has been given to both and one 20% of land for common use and we have the copy of that will. The property is of my Grandmother and of her brother but her brother is living there for past couple of years. And the will even says that my mother and her sister will also get the property after the death of my grandmother. So we want to know how can we ask our portion and live there. Since they are not allowing us to either live there or sell that. So any legal terms on which we can file a case on them?

In order to secure your property rights, in the given facts of the case as mentioned by you, you have to serve the opposite party with one solid legal notice. After that, in case they refuse to obey, file civil suit for partition and stay of property in question. Take expert advice from Advocate.

Hello In order to answer your question(s) a careful examination of the will is required and we may ask you some other questions also. It will be better if you meet us in person alongwith the will. We will be in a better position to provide you appropriate legal advice. Brij Mohan (Adv.)
