Refusal to refund the Booking Deposit for Flat purchase

I am based in Bangalore, looking to purchase a small Apartment. In July 2024, I responded to a posting for Sale of 2 BHK in Surathkal. Contacted the owner/ builder who indicated that freehold Flats are available for Sale. I then visited this site on 24th July 2024. and paid an advance token of Rs. 1 lakh, owner gave me receipts, assuring me that Registration will be done after 2 weeks. 3 months have passed, no sign of any preparation for Registration. Builder refusing to refund my deposit

Secondly have you checked the property and have you gone for a legal verification through a lawyer?
thirdly produce the receipt the concerned person gave.

As per your query above you have paid a sum of rs. 1 lakh ad token advance and you hold the receipt as well, if there is been any sale agreement executed between you and the owner/Builder then they have to execute the sale deed within the time mentioned in the sale agreement if there is no sale agreement executed between you both then you need to send a legal notice from advocate to refund the amount.
