Refund of booking amount on cancellation of unapproved project at Dwar

I had paid Rs.1 lakh as a booking amount in project Shahneiram under REVANTA MULTI STATE CGHS in year 2016.The project was to be completed in yr 2021.I had applied for loan for balance amount.When loan disbursement agency verified it found that the project is illegal also the Shahneiram not existing now and land not yet approved by Delhi Govt.I requested for refund but no suitable reply is being received by builder.

You may issue a legal notice seeking refund of the amount paid to the builder failing which a suit for recovery be filed in the concerned court having competent jurisdiction. We need to examine few things as to when was the payment made. When was the booking cancelled on account of misrepresentation??
