Ready to move in flat reserved but not booked

I have paid Rs.90000 as advance to one of the reputed builder who is also listed entity on stock market. They supposed to send me booking form to proceed ready to move in property. Now this property is booked by someone previously which is not cancelled yet due to some internal issues so they are not able to make the changes in the system. I have sent mail to investors relations and sales team but still no revert. I have added CEO also but still no revert on the mail.
That is unfortunate. This is a civil matter and your initial dealing and anything that you may have in writing will be relevant. Usually any booking payment made is accompanied with a booking agreement in which the terms of payment are expressly mentioned and if the payment terms are breached then it can result in forfeiture of the deposit. The quantum may be mentioned in the booking agreement, other than that there are other factors such as compliance with Rera, the circumstances under which you agreed to enter into the contract with the builder and consumer law. To understand your legal standing we will need to evaluate all circumstances to see it is worth it to pursue this matter and treat it as a bad experience.
