Re claiming of land mistakenly added to the property of a temple

14-Aug-2023 (In Property Law)
We are doing farming in our Agricultural land of my grandfather for the past 30 years. We have original mother document which is purchased from the person who sold. In the middle of these years, land surveyor one who come for valuation he mistakenly added our land into Temple property, we have not noticed this for long years. When we about to sell this property we came to know that it is registered in the name of temple property. Could some please guide us how to face this issue and what is the possibility to reclaim the land?

Your grand father might have purchased the land belonging to the temple from the seller and the person might have cheated him and there is a rule that temple land can not be sold . The land surveyor might have corrected the mistake and hence go to the Registrar office and find out the real position.

Based on the parent document which you claim is in your possession, you have to file a suit in the district court for setting aside the temple's claim, after serving the temple authorities with a legal notice.

There is no need to reclaim the title

Already title document stands in your name

You need to apply with the taluk surveyor for 're survey of land

Also take copies of title document and encumbtance certificate of your land and temple land

Submit it with surveyor for 're survey and he may Correct the error
