Query related to Father's Property

My father in law doesn't have a will and he passed away. He has 2 kids, one boy 27 years and one daughter 33 years(my wife) wants to give her share of property to her brother. We have 2 kids. Can she transfer her share without my consent, if yes then how can I stop her. Please advise.

Firstly let me know the way how your father in law got that property, whether it is self acquired? or devolved from ancestors?. After knowing this fact alone we can come to conclusion that your wife is having hold of share or not. If your wife gets share on her eligibility, she can very well release the same to her brother.

Hi, You have not mentioned your religion here. However i can tell you it is not advisable on the part of your wife to transfer her share to her brother. It will create a legal implication if she does so. Such transfer will not carry a proper title transfer.
