Query regarding Possesion letter
20-Jan-2025 (In Property Law)
I am going to buy a flat which was constructed and possesion given in 2010. i will be the third owner for this flat. flat is on finance and documents are in bank. while proceeding for the rgistration i came to know that the original possesion letter is missing which was issued to the first buyer from the builder.
Is there any complecation to proceed on this deal.
We would suggest to not proceed with registration unless you can see the entire chain. Possession letter is must. We can even get it checked from the office in case the current owner is unable to provide it. Additionally, if possession letter is missing, even rates of the property gets reduced since very few buyers buy it otherwise as it may or may not lead to litigation in future.
