Query regarding ancestral property split

07-May-2023 (In Property Law)
Hi, My father and his brother were united since their childhood so both families finances were also united. They have not earned a separate income apart from the common agricultural income. Now in the ancestral property they cheated my dad very badly. Total properties are below: 6 acres as a single plot 3.5 acres as bits and pieces having two people lands in between 1 acre as a single plot with an electric post and also we hold a certain part of ownership in a spinning mill but that too registered in their names as directors. They have taken the 6 acres plot for them and given the remains to us. Now even my dad passed away on April 10th of 2021. Could you please let me know how will it be if i raising a legal issue?. Will it be in my favor?. Is it possible can i get the share of spinning mill?

You can file a suit for partition in the court in which the property will be divided equally. Your father's share will be divided by his legal heirs. You can include all the properties for equal partition.

what is in case in this matter property City that Court has the jurisdiction to entertain the petition petition partition case and collect all the details of the property which are enjoyed jointly and joint ownership and after the demise of your father you have right to equality provide so they can not take more property when you accept it you can leave the property to them when you are not accepting it then the property should be divided by leaps and bounds
