Purchased flat in 2015 builder still not giving katha to flat owner

We purchased flat in 2015,which is Lic loan sanctioned, But the builder has not given us the katha for all the flat owners in our building till date and We are following up with builder but no response,What can be done to resolve this ? can the flat be sold with out Katha

Dear Sir/Madam,

Khata certificate, extract and possession certificate should stand in your name to convey the same.

In case of delay by the builder issue a legal notice seeking to transfer the Khata in your name

How come khatha is not transferred yet by the builder after selling it to you. Did you get the occupancy Certificate. Have you taken legal opinion before buying the flat. What is the clause and conditions of your sale agreement and sale deed contains. What if the owner is fail to comply his obligations being a seller towards buyer. Bring the documents we can issue one legal notice to him.

Sir,
It is the duty of the builder to issue khatha and khatha certificate once the registration is over. I dont know whether you had taken legal opinion before the purchase or not. Please ask builder. No it cant be sold without the Khatha. Because Khatha will be reflecting the name of person who is in possession and ownership

Please asj the builder to give the khatha certificate or you can directly approach the concern authority and obtain the khatha on the basis of Sale Purchase Deed.
