Property transfer from grandmother to grandson

10-Aug-2023 (In Property Law)
Hello, I am Hindu. My grandfather have passed away and my father in lone son of my grandparents along with 3 sisters of him. My grandfather had properties. My 2 aunts have no problem and are not interested in the property but one of my aunts keeps on threatening that she has equal right on property and can get it divided into equal share my grandmother has already given her one property but she is still eyeing on others. My aunt is 60 year old pensioner and have a steady income source can she claim her right on my grand mother's property and if so is there any way by which my grandmother could transfer the property on my name or make in any will through will my aunt's claim could be nullified. Kindly suggest.

If the property is in your grandmother's name then she can transfer it to any body and nobody can question it. But for that it has to be proved that the property exclusively belongs to her. Other wise your aunt will claim her share.

After death of your grandfather, the property vests in your grandmother, your father and all three aunts, accordingly all of them have one fifths share in the property . Hence ,your aunt can claim one fifth share of the property.
