In case your husband had left any Will the property will be inherited in accordance with the contents of the Will. On the contrary if he had died intestate the Succession Act would come in play and the property will be shared in terms of class 1legal hiers. If the person dies intestate then the property is bound to be distributed equally amongst all the living heirs.

But in case if all the legal heirs want the property to be transferred in one legal heir’s name, like in the present case is the mother, then all other legal heirs can give away their share to the mother by signing a Relinquishment deed in her favour and then get the property transferred in mother’s name based on the aforementioned procedure.
