property transfer from deceased husband to wife.

Husband has died without putting anyone his nominee on the property, the wife wishes to have the property on her name. the legal heir doesn't have any problem. what all papers are needed to transfer?, and what authority to approach?

In case your husband had left any Will the property will be inherited in accordance with the contents of the Will. On the contrary if he had died intestate the Succession Act would come in play and the property will be shared in terms of class 1legal hiers. You need to file a petition before the DISTRICT judge for succession certificate

you need to approach the sub registrar office in which the property is located.

the legal heirs can execute a relinquishment deed in favour of the lady to whom Devesh to transfer their share in the property.

transfer can also be made by way I
of gift deed or sale deed but they all would involve payment of stamp duty

If the person dies intestate then the property is bound to be distributed equally amongst all the living heirs.

But in case if all the legal heirs want the property to be transferred in one legal heir’s name, like in the present case is the mother, then all other legal heirs can give away their share to the mother by signing a Relinquishment deed in her favour and then get the property transferred in mother’s name based on the aforementioned procedure.

The first person to approach is an advocate and you need to hire him to explain you the legalities and to draft the relevant documents! Other legal heirs have to do relinquishment deed in your favour ! Kindly b in touch
