Property rights of 2nd wife over deceased husband's property

My father expired on June 05, 2014 left behind 7.57 acres(approx) of land without making any will. The property not yet partitioned. My step- brother has transferred 3.08 acres of land in his name with the help of my step-mother without knowledge of me and my two other siblings. And also done mututaion in his favour. My father got re-marriad while my mother was alive and there was no divorce. My step- staying separately since 1997. In view of the above: 1. My query is whether my step-mother can claim any share of my deceased father's property. 2. If no then what are legal options left for me to solved the issue. Shall be grateful for your advice. Thank you

since there was no divorce at the time of 2nd marriage then the 2nd wife has no legal right in the property of your father neither can she claim as the second marriage is null and void in eye of law..

Step mother cannot claim any share. To give opinion it is necessary to how many step sibling you have and when how such name transfer in property share had been done and when you came to know about it. If you wish to take my Legal opinion professionally upon online payment then can contact.
