Property rights as a daughter and daughter in law_____________________

09-May-2023 (In Property Law)
Hello, I am a female aged 35 and belong to the Roman Catholic religion. I would like to know my rights to my parent's property and bank holdings. I have a younger brother too. On another note, I would be getting married to a Hindu whose family has this HUF system. Would I be a part of the HUF since I belong to a different religion? Would our marriage affect my would-be husband's status in a HUF? Overall I do have a general idea of my rights as a daughter but it would be helpful to get a detailed overview of both these aspects.

Yes you will have exclusive right in the property of your father in same ratio as your brother get. As per Indian succession Act. Even if you get marry with Person from Hindu community but said marriage will be get Registered as per Special Marriage Act and not as per Hindu Marriage Act. So In such scenario Hindu Succession Act will not b applicable to you but that will be Indian Succession Act.

This is my response to you:
1. You have 33% rights over the property;
2. The other rights are of your mother and sibling;
3. Once you convert your religion then you have rights over their property in an HUF;
4. If you do not renounce your religion then you continue to be catholic and therefore cannot be part of HUF;
5. Consult a local lawyer and take steps.

U have full right in your fathers property, unless your father gives it to somebody( when he is alive) through a Registered Agreement and/or makes a WILL and bequeates it to somebody after his death.

U marring a Hindu does not have any impact on HUF and your rights of your husband

Yes, u can be a part of HUF if u are legally married.

Can call me for any other legal advise
