You need to file for partition if father is no longer alive. if father is alive, you can have him make a gift deed of 50% share in your name. in case he doesn't want to make a gift deed right now, you can have him make a will bequeathing the property to you and your brother.

you can file a partition suit claiming your part of the property and seek your right of share in the said property provided the property shall be ancestral and not your fathers own earned property and also by what way your father tranferred the said property
